If you are injured or become ill, either physically or mentally, because of your job, including injuries resulting from a workplace crime, you may be entitled to workers’ compensation benefits, sometimes referred to as workers' comp, workman's compensation, workmen's compensations, or simply work comp benefits.
In California, the workers’ compensation system is a “no-fault” system. If you suffer an injury on the job, you file a worker’s compensation claim against your employer, and your employer is then required by law to provide you with workers' compensation benefits, including medical treatment, all without your having to prove whose fault it was.
There is a trade-off though. On one hand, the injured worker is supposed to get quick and easy access to medical treatment and disability benefits. On the other hand, the employer is protected from any lawsuits over the injury which the injured worker is not allowed to bring, with the exception of certain very limited circumstances.
This trade-off is not always in the injured worker’s favor, however. For example, workers’ compensation benefits do not include compensation for things like lost earnings and pain and suffering, which are allowed normally in a regular lawsuit.
In certain cases, though, an injured worker may be able to file both a workers’ compensation claim against the employer and also a separate lawsuit against a non-employer third-party that may have caused the work-related injury. These are called “Third Party Claims” and only a limited number of workers’ compensation attorneys have the right knowledge, expertise, and resources to properly handle these special types of cases.

Selecting your Primary Treating Physician PTP
Unless your employer has a Medical Provider Network (MPN), you have the right to select your own physician 30 days after the date your injury was reported to your employer.
When you select your treating physician, you or the physician needs to give written notice to your employer.
Selecting your Primary Treating Physician (PTP) is one of the most important choices you will have to make in your worker’s compensation claim. This is because not only do you want to receive the best medical treatment for your injury but also because most of your other worker’s compensation benefits will be based on the opinions and reports from your PTP. Your PTP will also determine if and when you can go back to work and in what capacity. So, you want to make sure to pick the best treating physician for all of these needs.

Why you shouldn’t attend the QME Evaluation:
If you are an injured worker who is not represented by an attorney and choose a Qualified Medical Evaluator (QME) from a state issued QME panel, but do not actually go to the QME doctor, you will have an opportunity to pick another QME if you hire an attorney.
If you attend and participate in the QME evaluation, then there are other ways to challenge the doctor's conclusions. However, this is usually an uphill battle, at best. Know this, picking the wrong QME can be disastrous to your California workers’ compensation case.
The lesson here is to always consult with a California workers compensation attorney before you choose a QME.

WHAT TO EXPECT AT THE SAN DIEGO WCAB LOCATION
Even though it is called "Appeals Board" - this is really the trial court. It is where Judges hear your evidence to determine whether you get workers' compensation benefits.
The WCAB is on the 2nd Floor and there are double doors, right off the elevator. When you come in you will see a lot of seats to your right. It looks sort of like a DMV office. You will need to walk to your right to a sign in table.

If you have a San Diego Workers Compensation Lawyer you need to sign in and then wait for your San Diego Workers Compensation Attorney.
What to do if you don't have a San Diego Workers' Compensation Attorney:
If you don’t have a lawyer then you need to go down the hall to your right in order to find the Judge that is Hearing your case. At this point you will need to communicate with the the Workers Compensation Defense Attorney. See more on that below.
Can I Be Fired By My Employer For Bringing A Workers' Compensation Claim?
What happens when an injured worker is fired for bringing a California workers’ compensation claim? What happens when witnesses are fired for testifying for an injured worker in a California workers’ compensation claim? Can the employer simply fire these workers? These are very real concerns to so many workers.
Rest assured that California workers’ compensation law protects you if you are discriminated against for filing a California workers’ compensation claim. California law specifically prohibits an employer from firing injured workers for exercising their right to compensation under the California Labor Code. California Labor Code Section 132(a) provides for criminal penalties for any employer who “… in any manner discriminates against any employee because he or she has filed a claim for compensation or made known his or her intention to file a claim for compensation with his or her employer. This is known as a “132(a) discrimination claim.”
It should be noted that in order to benefit from California Labor Code Section 132(a) you have to have already filed a claim or made it known to your employer that you intend to file a California workers’ compensation claim.
